Shoot, I didn’t get the golden ticket! Well, better luck next time. I’m very anxious to find out who will get the “phrase that pays” and if anyone will.

    Golden Ticket Hack
What is to stop someone from doing many HTTP HEAD requests watching the ETAG, when it changes grab that one? The ETAG needs to be faked to look the same for all files.
The Golden Ticket is a great idea.

This is the email that I sent to Pod2Mob yesterday. They haven’t responded. Feel free to cut it up and amend it as you see fit. Of course, this doesn’t constitute legal advice, and if you’re really seriously questioning the legality of all of their actions, you should check in with your friendly, neighborhood, attorney.

    Pod2Mob.com:

It has come to my attention that you are listing various podcasts and inserting advertisements into the podcasts without the express authorization of the creator. Please be advised that I am an attorney in the State of New Jersey and Commonwealth of Pennsylvania, and the host of “The Jersey Toddshow” / http://www.jerseytoddshow.com.

PLEASE TAKE NOTICE that “The Jersey Toddshow” is a non-commercial podcast. Any use of my show for any commercial venture without my express, written, permission is strictly prohibited. Should you list my podcast or insert advertisements into my podcast without my permission, I will seek injunctive and punitive relief in all available forums. Further, I will seek to be indemnified and held harmless from any artist or other copyright holder who wishes to seek damages against me for your use of my podcast in a commercial venture without my consent.

Please be guided accordingly. If you are indeed inserting advertising on podcasts without the podcasters approval, then I strongly suggest that you rethink this aspect of your business model.

    Adam,

I emailed an audio comment that says pretty much the same thing.

On DSC 362, it cracked me up when right after Madge’s answer to you golden ticket, the Earthlink Fairies chime in with “do you believe ANYTHING is possible?”! Did you do that on purpose?

    I’m not a pilot so, so… Unrestricted bandwidth!…

DESPERATELY! Waiting for my Podshow invitation…

Regarding Big Giant Button, http://www.biggiantbutton.com and Goldenticket, cool web 2.0 ideas.
Wonder if something like this could be personalized on PSN websites, add a comment and push button for possible free music download, etc.

yeah, kind of funny – BUT in reality this was just a cheap trick by Adam to avoid discussing the Podshow contracts at all.

[...] There has been a lot of talk in recent months, among podcasters, about the terms of the PodShow contract being offered. Mostly the talk has been rumor and innuendo. No more. You can now hear all the details. For those that are curious, Keith and The Girl did a show where they read all 12 pages of the contract. The next day Adam Curry ran a “bit” on the Daily Source Code referencing the Keith and The Girl segment. Of note: Adam made no mention that there were any inaccuracies, so we can assume it is the actual current contract. I’ll leave listeners to draw their own conclusions, but you can’t help but come away realizing that it is full of generalities. PodShow might be the perfect opportunity for a given podcaster, but contracts by nature should be explicit, not implicit. [...]

We only just announced http://www.pod2mob.com Monday and already
there’s been some tremendous buzz, which has lead to some confusion
and misinformation, so we wanted to take this opportunity to clear the
air and ask for your help.

Pod2Mobile was the first company to extend podcasting into the
wireless world. With iPods and MP3 players, your potential audience
is limited to people who have bought one of those devices, but with
the advent of our software, the potential audience is extended to the
800million cell phones already on the market worldwide, around
200millon in the US alone. One of those fancy research firms
predicts that by 2010, there will be one billion cell phones on the
market. Think about it, not everyone owns an iPod but almost
everyone has a mobile phone — and we carry them everywhere we go!
With today’s unlimited data plans, it is not prohibitive for people
to use their cell phones to listen to your podcast.

We are not just another podcast directory site. Pod2Mobile expands
the potential audience for podcasters dramatically. Broadcast
advertisers haven’t taken podcasters seriously out of the mistaken
belief that the podcasting audience hasn’t reached critical mass.
Now that listeners can play shows on demand as easily as turning a
dial, we expect a large mainstream audience to grow that will
ultimately support hundreds of podcasters and the shows they love to
    produce.

However, there is a considerable cost to keep our service up and
running, much less developing it into a platform for podcasters to
build their own new media empires. Our service is FREE for listeners
and it is also FREE to podcasters. We do not charge for hosting or
delivering episodes and streams. Right now, the single ad that is
inserted before an episode is the only means of defraying costs. It
serves to keep all the equipment and software running and supported.
This simple ad program also creates metrics and statistics to prove
the advertising model to Madison Avenue and move the world of
podcasting further away from a hobbist activity to a thriving
professional industry. This is where we need your help!

In the immediate future, we expect to roll out our beta program for
ad revenue sharing with podcasters. Our intention is to establish a
platform for new and reinvented careers in broadcasting. We need
podcasters to work closely with us to develop an advertising program
for producers and jockeys to make sure that they have enough control
over the placement and content of the commercials but still create
enough value for big and little brands to sponsor independent
publishing and podcasting. This is a fast moving, ever-evolving
space and we welcome new ideas and approaches.

Finally, we do not take anyone’s podcast without their permission.
Everytime a podcast is submitted, we get a sign off to distribute it.
If your podcast is listed on our service and you don’t want it there,
drop us a line and we will remove it right away. But we think we are
growing your audience at no cost to you and serving your listener’s
preferences and needs – - and that’s why we created Pod2Mobile in
    the first place!

Thanks again for your interest. The future is very exciting for all
of us. Please write to us at questions@pod2mob.com with any
    feedback, ideas or questions.

Adam, way to skirt around the KATG issue with your lame skit.

Why not actually address the contract issue?

Your podcast tries to act like it’s against “The Man”, but your contract
    makes you the man.

    Lame.

    You’re ruining poscasting.

Also, loved the “oh, I missed a charter plane phone call”, and the usual Curry Cottage,

Adam Curry wants to be The Man so bad it hurts. Saying to Regan Fox and Madge that there are 100 others just like them, that someone has to nag him and nag him and leave a ton of messages to get his attention.. it’s just to stroke his own ego. I’m sure he rubbed out a good one to DND.

What you’re selling, Adam, no one’s buying. I give it a year or two.

  23.

Nice try, Brad, but podcasts ARE listed on your service WITHOUT the author’s permission, expressed or implied.

    ASK FIRST.

Jersey Todd is my attorney BTW, all contracts go through him.

Geez mali, that was a bit harsh. I’m not disagreeing that the Fox/Madge comments were a bit out of order, but rubbing one out to DND? Hrrmmm…

This is the response that I got back from pod2mob today….a form letter with two sentences added.

    Dear Todd,

the podcast industry. We only just announced it on Monday and already

I’m going to go against a couple of people here on this one, which is surprising cause I normally agee with them. But, I thought how the KATG thing was handled was well done from a business and professional view.

Whethe the contract is good or not, atleast AC responded in a positive way. I am also impressed by how he’s dealt with the http://www.pod2mob.com issue.

First DSC I’ve enjoyed for a while.

I have to say I really enjoyed today’s show. I thought the skit was pretty damn funny and out of all the ways you could have handled it, you showed some creativity and some class.

I’ll be the first to admit that I’ve been critical of Adam and Podshow in the past, but this was really well done.

    Hi Adam,

A few episodes back, you mentioned that your enterprise is actually
called the “Podshow Music Network.” There was some frustration in
your voice as the previous audio feedback mentioned “Podsafe” instead.

At the end of DSC #361 (55:54), you also said: “…Podsafe Music
Network.” See, how easy it is for the layman to become confused too?
We simply repeat what we hear!
